● Reverse Engineering: Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of ApexBrowse Browser or any part of the Services.
● Unauthorized Commercial Use: Use the Services for any commercial purpose without our express written consent.
● Impersonation: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
● Violation of Rights: Infringe upon or violate our intellectual property rights or the intellectual property rights or other rights of others.
● Automated Access: Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
● Bypassing Features: Attempt to bypass or circumvent any security measures or features of the Services, including but not limited to ad-blocking or VPN functionalities, for purposes other than their intended use within the browser.
All intellectual property rights in and to ApexBrowse Browser and the Services, including but not limited to copyrights, trademarks, patents, trade secrets, and other proprietary rights or its licensors. You acknowledge that you do not acquire any ownership rights by using the Services.
● Trademarks: The ApexBrowse Browser name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks or its affiliates or licensors. You must not use such marks without our prior written permission.
● User-Generated Content: If the Services allow you to submit content (e.g., custom themes, extension reviews), you retain ownership of your content. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the Services and our business.
ApexBrowse Browser may include or provide access to third-party content, websites, services, and extensions (e.g., default search engines, news feeds, installed extensions). Your interaction with these third parties is solely between you and the third party, and is governed by their respective terms of service and privacy policies. We do not endorse, nor are we responsible for, any third-party content or services. You use such third-party content and services at your own risk.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
● THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
● THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.
● THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.
● ANY ERRORS IN THE SERVICES WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE AMOUNT YOU PAID TO US TO USE THE SERVICES (IF ANY) OR $50 USD, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Services, by you or any person using your account and password; b) a breach of these Terms; or c) content posted by you on or through the Services (if applicable).
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
These Terms shall be governed and construed in accordance with the laws of EU.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be primarily resolved through good faith negotiations. If a resolution cannot be reached informally, the dispute shall be submitted to the exclusive jurisdiction of the courts located in EU.
● Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and ApexBrowse browser regarding the Services.
● Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
● Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
● Assignment: You may not assign any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
